The Contractor is an independent contractor and not an employee of Delivery Service Partner.
The Contractor is responsible for their own taxes, insurance, vehicle maintenance, and work-related expenses.
Delivery Service Partner acts only as a broker and does not employ drivers directly. Payments are made after deducting Delivery Service Partner's brokerage fee.
Delivery Service Partner is not responsible for any penalties imposed due to the Contractor's mistakes. The Contractor is fully responsible for any penalties, which will be deducted from their earnings or paid out of pocket if necessary.
The Contractor must send updates on delivered packages to the manager every 2 hours, which includes the time they start delivery in the morning, lunch breaks, tea breaks, and especially how many packages have been delivered by 12 PM and 6 PM.
The Contractor must keep proof of returns, including a picture of the label and information about whom the package was returned to.
The Contractor must start work at exactly 6:00 AM in the morning.
If the Contractor starts 15 minutes late, they must provide a valid reason.
If the Contractor starts 30 minutes late, it will result in a first oral warning. If this happens 3 times, the company may impose a fine of $10. If it happens more than 5 times, the company may ban the account and terminate the Contractor after issuing a written warning.
If the Contractor starts 1 hour or more late, the company may charge up to $50, and if the route is not completed before 10:00 PM, no payment will be made for that route.
The Contractor must complete all assigned deliveries for any accepted route.
If the Contractor cannot complete a route, they must arrange for a replacement at their own cost.
If the Contractor confirms a route but later refuses to pick it up, they must pay a $50 penalty.
If the Contractor needs to take leave, they must inform Delivery Service Partner at least one day before the scheduled pickup, before 12:00 AM.
The Contractor must take clear photos of the delivered package, including:
Packages cannot be left outside of a closed business.
The Contractor must take screenshots of their app ID at 11:55 PM, 6:00 PM, and 10:00 PM to verify progress.
The Contractor must keep clear photos of all completed deliveries (meeting the proof of delivery requirements) for a minimum of 60 days after the delivery.
If a customer complains about not receiving a package within 60 days, it is the Contractor's responsibility to provide correct proof of delivery (POD) to the company. If the Contractor fails to provide the correct POD or proof of return, they will be charged an amount set by company policy.
Every delivery requires 3 clear and accurate photos, no matter what. If the Contractor is unable to meet this requirement, they will be responsible for a fine set by the company (as this is a basic standard of the company: 3 PODs).
If a package is lost due to the Contractor's negligence, $200 will be deducted from their earnings.
If the Contractor is not working regularly, has missing deliveries, or fails to provide proper proof of delivery, they will be responsible for any penalties imposed by the shipping company.
The Contractor is fully liable for penalties and must pay them from their earnings or personal funds if the penalty exceeds their earnings.
If the Contractor works for only 1 or 2 days, their 50% payment will be released only after Delivery Service Partner receives the final penalty sheet from the shipping company.
If the Contractor leaves without giving a 5-day notice, they will receive only 70% of their total earnings.
Payments will be processed after Delivery Service Partner deducts its brokerage fee.
All undelivered packages must be returned within 24 hours of the failed delivery attempt.
If driver is unable to return returned packages company can consider it lost and impose fine.
If any one pick route from wearhouse and not respond to company and also not deliver to customer they will be responsible for that and it can be report to police and appropriate actions can be taken to that person and Delivery Service Partner is not responsible for that and driver will 100% for any loss to company and he is payable.
The following pay rates are after Delivery Service Partner's brokerage fee deductions:
Pay rates are subject to change based on any adjustments made by Delivery Service Partner.
This Agreement shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein.
This Agreement constitutes the entire agreement between the parties and supersedes all prior agreements, understandings, or representations, whether oral or written.
